Derek Hay: Jane Does' Complaint Will Be 'Vigorously Defended'

LOS ANGELES—LA Direct Models owner Derek Hay, in a prepared statement on Monday, said the Labor Board complaint filed against him and his agency by four “Jane Doe” adult performers would be “vigorously defended.” Hay was served the complaint on Saturday. On July 4th he told AVN that he was unaware of the complaint, although attorney Allan Gelbard, who filed it on behalf of the Jane Does with the Department of Industrial Relations for the State of California, maintains that it was served to LA Direct Models at the beginning of July. Gelbard told AVN Monday that he felt it was necessary for the complaint, which claims that Hay and his agency have violated several laws that govern talent agents, to be served both to the company itself and to Hay personally, since both are individually named as respondents. Hay's statement follows: “To whom it may concern, “For the purpose of clarity and to remove any chance of a claim of ‘not being aware of the facts.’ “I was served with the Labor Board complaint on Saturday, July 21st at approximately 5 p.m. EST, being the complaint using attorney ‘Allan Gelbard’ and having four (4) Jane Doe plaintiffs. “This is the same complaint first published on AVN.com on July 4th, and upon which, when asked for comment by AVN on that date, I replied I could not comment as I had neither read nor been served with the complaint, nor at the time of that phone call had any knowledge of its existence. “Simple math would show that is seventeen (17) days between AVN publishing said complaint and my actual receipt of service of it. “The complaint will be vigorously defended. “No further comment will be made at this time.”
